The incident occurred Tuesday evening in Netmizaaggamig Nishnaabeg, according to a news release issued by the Anishinabek Police Service Thursday. The me, both from Blind River, are facing a combined 27 charges. 

According to the release, officers were conducting a R.I.D.E. program, when the BMW approached.

Officers identified the driver as a suspended driver and allegedly detected the odour of cannabis coming from the vehicle.

The driver was asked to pull the vehicle over, but instead accelerated forward at a high rate of speed, police said.

The vehicle continued through the community, said police, before entering White Lake and coming to rest underwater, about 50 feet from the shore.

A “high-risk arrest” was conducted after the driver and passenger exited and began swimming across the lake and returning to the beach of White Lake Provincial Park.

Both parties were taken into custody without incident, said the release.

A Glock 22 has been recovered from the scene.

“The Glock was loaded with five hollow point bullets, had an extended magazine, and was equipped with a Glock switch (an illegal, aftermarket device attached to the rear of the slide that renders the gun into a fully automatic weapon). Its serial number had been defaced,” the release continued.

The 28-year-old driver is facing 15 charges, including driving while under suspension, flight from peace officer, and making an automatic firearm.

He was previously charged, in June of this year, with dangerous driving causing bodily harm and obstructing justice, following a side-by-side collision.

The passenger, a 21-year-old man from Blind River, is facing 12 charges, including obstructing a peace officer, carrying concealed weapon, and possession of a weapon for a dangerous purpose.

Police did not identify the accused. The release said both individuals were held for bail.

Both accused had been living with community members, said police. “As a result, under the new Netmizaaggamig Nishnaabeg trespassing and safety Naaknigewin, trespass notices have been issued to both parties by the Anishinabek Police Service.

“This law – in effect since Sept. 3 – provides APS officers with the lawful authority required to work with the community to trespass individuals who are causing harm,” the release said.

The release confirmed that this is the first incident in which the Naaknigewin has been applied.

新法規首次應用:驅逐有害個人
警方表示,兩名嫌犯當時住在社區成員家中。根據 9 月 3 日生效的新《內特米扎加米格納布格侵入與安全法規》(Netmizaaggamig Nishnaabeg trespassing and safety Naaknigewin),阿尼什納貝克警察局已向這兩人發出侵入警告。新聞稿指出:「這項法律賦予警察合法權力,與社區合作驅逐那些造成危害的個人。」同時證實,這是該法規自頒布以來首次被應用。
